1. Introduction

Search Hype ("we," "our," or "us") is a digital agency founded in 2023, headquartered at Karbala Tank Road, Ranchi, Jharkhand - 834001, India. We provide a comprehensive range of digital services including:

2. Definitions

• "Client," "you," "your" refers to the individual or entity using our services.
• "Services" refers to all digital solutions provided by Search Hype.
• "Project" refers to a specific scope of work agreed upon between you and us.
• "Deliverables" refers to the final products, code, designs, or materials provided as part of the project.
• "Agreement" refers to these Terms of Service along with any project-specific statements of work.
• "Intellectual Property" includes copyrights, trademarks, patents, trade secrets, and other proprietary rights.

3. Services and Project Engagement

3.1 Project Initiation

Projects begin when:

• You submit a project inquiry through our website contact form, WhatsApp, or email
• We discuss requirements and provide a proposal
• You accept the proposal and pay the required deposit (typically 30-50%)

4. Pricing and Payment Terms

4.1 Service Pricing

Our service pricing varies based on project scope. Below are indicative price ranges based on our service pages:

• Deposit: 30-50% advance payment required to start the project
• Milestone Payments: For larger projects, payments are tied to deliverables
• Final Payment: Remaining balance due before final delivery
• Recurring Services: Monthly plans are billed at the beginning of each month

4.3 Payment Methods

We accept the following payment methods:

• UPI (Unified Payments Interface)
• Bank Transfer (NEFT/IMPS/RTGS)
• PayPal (for international clients)
• Razorpay (credit/debit cards, net banking)
• International Wire Transfer

4.4 Late Payments

Payments not received within 7 days of the due date may result in a pause of work. Projects with payments overdue by 30 days may be terminated with all deposits forfeited.

5. Revisions and Change Requests

5.1 Revision Policy

• Website/App Development: 2 rounds of revisions included (minor changes)
• Video Editing: 2 free revisions for standard projects, 3 for advanced
• Design Work: 2 rounds of revisions included

5.2 Scope Changes

Any requests that significantly change the original project scope (new features, additional pages, major redesign) will be treated as change requests and may incur additional charges. We will provide a quote for such changes before proceeding.

6. Intellectual Property Rights

6.1 Ownership

• Upon Full Payment: You receive 100% ownership of the final deliverables (source code, designs, content)
• Pre-existing Materials: We retain rights to any pre-existing tools, libraries, or frameworks used in development
• Third-party Assets: Any third-party assets (fonts, images, plugins) are subject to their respective licenses

6.2 Portfolio Rights

We reserve the right to display completed projects in our portfolio, case studies, and promotional materials unless a non-disclosure agreement (NDA) is signed.

6.3 Confidentiality

We treat all client information as confidential and will sign NDAs upon request to protect your ideas and project details.

7. Cancellation and Refund Policy

7.1 Project Cancellation

• Before work begins: 90% refund of deposit (10% administrative fee)
• During initial phase (first 25%): 50% refund of deposit
• After 50% completion: No refund, but you receive work completed to date

7.2 Monthly Services

Monthly marketing/SEO plans can be canceled with 15 days' notice. No refunds for partial months.

7.3 Satisfaction Guarantee

We strive for 100% client satisfaction. If you're not satisfied with the work, we'll work with you to make it right through our revision process.

8. Support and Maintenance

8.1 Post-Launch Support

• Bug Fixes: 30 days free bug-fixing support after project completion
• Documentation: Basic documentation provided for all projects
• Training: Basic training on content management (where applicable)

8.2 Maintenance Packages

Optional maintenance packages available for:

• Security updates and patches
• Regular backups
• Performance monitoring
• Content updates
• Starting at ₹999/month

8.3 Response Times

9. Limitation of Liability

To the maximum extent permitted by law, Search Hype shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from third-party services or integrations

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific project giving rise to the claim.

10. Warranties and Disclaimers

10.1 Our Warranties

We warrant that:

• Services will be provided with reasonable skill and care
• Deliverables will conform to the agreed specifications
• We have the right to provide the services

10.2 Disclaimers

Except as expressly stated, our services are provided "as is" without warranties of any kind, including:

• Uninterrupted or error-free operation
• Specific search engine rankings (SEO results may vary)
• Compatibility with all third-party systems

11. Indemnification

You agree to indemnify and hold harmless Search Hype, its employees, and contractors from any claims, damages, or expenses arising from:

• Your use of our services
• Your violation of these terms
• Your violation of any third-party rights
• Content or materials you provide

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand.
